JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Taraiya P.S. Case No. 295 of 2016 instituted under Sections 272, 273, 295/34 of the Indian Penal Code and Section 30(a), 38, 41 of Bihar Prohibition & Excise Act 2016. The allegation, in brief, is that a trunk containing 200 litres of country made liquor was recovered from the premises of graveyard. Learned counsel for the petitioner submits that there is no recovery from the petitioner. The FIR itself shows that some villagers disclosed the name of this petitioner and there is no other material against the petitioner and he has also got no criminal antecedent.

Patna High Court Cr.Misc. No.5683 of 2017 (2) dt.07-02-2017 Considering the facts and circumstances of the case, let the petitioner, namely, Anil Singh in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.II, Saran at Chapra in connection with Taraiya P.S. Case No. 295 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
