Petitioner is seeking anticipatory bail in connection with CIS No.56 of 2019, arising out of Rafiganj P.S. Case No. 13 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, when the police party raided the house of the petitioner, 7 liters of illicit country made Mahua liquor was recovered from her house.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that from the seizure list it would appear that it is the only name of the village has been mentioned and not the residence of this petitioner. Learned APP for the State is present and has opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case particularly that in the seizure list only the name of the village has been mentioned and not the residence of this petitioner and further that this petitioner is a lady member of the family having no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cumSpecial Judge, Excise Act, Aurangabad in connection with CIS No.56 of 2019, arising out of Rafiganj P.S. Case No. 13 of 2019, subject to the condition prescribed under Section 438(2) of the Cr.P.C.
