JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,341,323,307,337 and 504 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the petitioners assaulted with bricks on the head of the informant when wife of the informant and neighbours came to rescue then on the order of co accused Chamauli Paswan, co accused Bijay Paswan fired by pistol causing injury to Randhir Paswan and co accused Nityanand assaulted the informant with fists and slaps. It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.37559 of 2015 (2) dt.17-09-2015 2/2 that injury of the informant has been found to be superficial simple in nature. There is counter version of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. More over, specific accusation of assault is against co accused Bijay Paswan and Nityanand Paswan. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Sare P.S. Case No. 38 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
