The petitioner being the husband of the complainant is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498(A) of the Indian Penal Code and 3⁄4 of the D. P. Act.

The basic accusation is of torture for nonfulfillment of dowry demand. This Court vide order dated 04.07.2014 issued notice to the complainant and her second husband i.e., opposite party nos. 2 and 3 but in spite of valid service of notice, none appears on behalf of them. Though a statement has been made in paragraph

Patna High Court Cr.Misc. No.11902 of 2014 (6) dt.16-02-2015 2 / 2 no. 6 of the petition that the petitioner is still ready to keep the complainant as wife with full dignity and honour. Further statement has also been made in paragraph no. 7 of the petition that the complainant has already married with one Sunil Yadav.

Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Complaint Case No. 360C of 2011 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
