JUSTICE SANJAY PRIYA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Fatuha P.S. Case No. 257 of 2016 initiated for the offence under Sections-420, 290 of the Indian Penal Code and Sections-47, 51, 54, 57 of the Bihar Excise (Amendment) Act, 2016.

There is allegation in the written report that the police got information that illegal illicit liquor has been stored in the jont house of this petitioner along with Krishna Prasad and Miku Devi with the help of Radheshyam Prasad. All the accused persons fled away on seeing the police party. The police party in presence of two witnesses made search of joint house of this petitioner, Radheshyam Prasad and Krishna Prasad and recovered 200 litres of country made liquor.

Patna High Court Cr.Misc. No.15000 of 2017 (2) dt.12-04-2017 2/2 In such circumstance, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner may surrender in the court below and pray for regular bail which shall be disposed of by court below in accordance with law without being prejudiced by order of this court.
