Petitioner seeks bail in G.O. Case No.297 of 2018 giving rise to Excise Case No.914 of 2018 instituted for the offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that petitioner has clean antecedents.
In the written report, it is alleged that during checking of bus, which was coming from Kolkatta to Biharsharif, 129.45 litres foreign liquor was recovered from the plastic bag, which is said to belong to this petitioner.
It is mentioned in prosecution report that petitioner
Patna High Court Cr.Misc. No.61907 of 2018 (2) dt.05-10-2018 2/2 has confessed his guilt before the police.
Counsel for the petitioner further submits that petitioner is a student. He was just travelling in the said bus. He has been made accused merely on suspicion. He is in custody since 01.09.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Nawadah, in connection with G.O. Case No.297 of 2018 giving rise to Excise Case No.914 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
