The petitioner is seeking anticipatory bail in connection with Murliganj P.S. Case No. 01/2019 registered under Sections 135 of the Electricity Act, 2003. Learned counsel for the petitioner submits that although he is disputing the allegations made in the F.I.R. but at this stage without prejudice to his contentions is willing to deposit 50% of the alleged amount of Rs. 3,24,504.00 in the court below subject to result of the case.

Learned AP.P. for the State has opposed the prayer for anticipatory bail of the petitioner. It is submitted that the petitioner was found involved in theft of electricity by cutting service wire from his domestic connection and bypassing the

Patna High Court CR. MISC. No.18252 of 2019(2) dt.01-04-2019 2/2 meter which caused a loss of Rs. 3,24,504.00 to the North Bihar Power Distribution Company Limited, Patna.

Considering the facts and circumstances of the case and that the petitioner is ready and willing to deposit 50% of the alleged amount to the Power Company, in the event of his arrest/surrender before the court below within a period of six weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M. Madhepura, in connection with Murliganj P.S. Case No. 01/2019, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.

The petitioner along with bail bond shall submit receipt showing deposit of 50% of the alleged amount of Rs. 3,24,504.00 with the North Bihar Power Distribution Company Limited which will be subject to the result of the present case. (Rajeev Ranjan Prasad, J) Rajeev/- U T
