1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 20(b)(ii)B of the NDPS Act.

3. Learned counsel for the petitioner submits that petitioner has antecedent of three cases and the informant alleges that on 07.10.2024, the railway police, during checking, arrested Kanchan and Anil and from the trolley bag, carried by them, 6 packets Ganja from each trolley bag weighing 1 Kg. each was recovered, hence, total 12 Kg. Ganja was recovered.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name transpired in the confessional statement of apprehended accused in police custody which does not have any evidentiary value in the eye of

Patna High Court CR. MISC. No.19449 of 2026(5) dt.29-07-2026 2/2 law. It is further submitted that even recovery of ganja is from the named accused persons.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner has antecedent of three cases and his name has transpired in the confessional statement of apprehended accused from whom ganja was recovered as detailed in the FIR. It is further submitted that investigation in the case is continuing and if petitioner is innocent, police will submit final form.

6. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Chapra G.R.P.S. Case No. 213 of 2024 pending in the Court of learned District & Sessions Judge-cum-Special Judge, NDPS, Saran at Chapra/Successor Court.

7. Hence, the prayer for anticipatory bail is rejected. (Satyavrat Verma, J) Kundan/- U T
