Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Mahishi P.S. Case No. 139 of 2019 corresponding to Special (Excise) Case No. 417 of 2019, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Earlier, the bail application of this petitioner was rejected by this court. This is the second attempt. It is submitted on behalf of the petitioner that petitioner is in custody since 03.09.2019. Moreover, charges

Patna High Court CR. MISC. No.18816 of 2020(3) dt.09-07-2020 2/2 have been framed.

In view of the fact that arms have been recovered from the possession of the petitioner who is having criminal antecedent, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. The trial court is directed to conclude the trial within nine months from today.
