The petitioner seeks bail in a case registered for the offences punishable under section 7 of the Essential Commodities Act.
The allegation in the F.I.R. is sale of, subsidized rice meant for the needy people, in the black market by the petitioner. Submission is that the petitioner is not a P.D.S. dealer. Hence the offence alleged is not applicable against the petitioner nor there is any evidence of direct involvement of the petitioner in the crime.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount
