The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 307, 353, 332, 333, 224, 225, 337, 504 of the Indian Penal Code.

It is alleged that when police apprehended Asger Alam @ Babloo, wanted in Jokihat P.S. Case No. 49 of 2012, then the mob attacked on police force and started pelting stones and 19 First Information Report named accused persons got the apprehended accused released. It is submitted by the learned counsel for the petitioner that accusation is against mob and other accused persons have been granted bail vide Cr. Misc. No. 24609 of 2014. Though the petitioner is accused in two other cases

Patna High Court Cr.Misc. No.37441 of 2015 (3) dt.24-09-2015 arising out of the civil nature of dispute.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat (Mahalgoan) P.S. Case No. 363 of 2012, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
