JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code, Sections 25(1-b)a, 26 of the Arms Act, Section 47(A) of Excise Act and 47(F)/53(A) of New Excise Act, 2016. Petitioners are said to have been caught along with two other persons when they, allegedly, had assembled to make preparation for committing dacoity. Country made pistols are said to have been recovered from their possession and so far as petitioner no. 2 is concerned, it is also stated that four litres country made mahua liquor was recovered from his possession.
Patna High Court Cr.Misc. No.36865 of 2016 (2) dt.05-09-2016 2/2 Petitioners do not have any criminal antecedent and are languishing in jail custody since 24.05.2016. Moreover, the informant claims in his written report that petitioners and their associates had assembled to make preparation for committing kidnapping.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, Judicial Magistrate 1st Class, Jamui in connection with Lakshmipur P.S. Case No. 69 of 2016. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
