Petitioner seeks bail in connection with Phulwaria P.S. Case No. 169 of 2016 registered under Sections- 272, 273 and 290 of the Indian Penal Code and section 30, 35 and 38 of the Bihar Excise (Amendment) Act, 2016.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to village politics. Petitioner was in Mumbai at the relevant time. Similarly situated co-accused persons have been granted privilege of anticipatory bail by this Court vide orders dated 18.03.2017 and 30.03.2017 passed in Cr. Misc. Nos. 10975 of 2017 and 9297 of 2017 respectively.
Patna High Court Cr.Misc. No.16527 of 2017 (2) dt.19-04-2017 2/2 Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Begusarai, in connection with Phulwaria P.S. Case No. 169 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
