JUSTICE SANJAY PRIYA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Yadopur P.S. Case No. 76 of 2015 instituted for the offence under Sections 366A, 504 and 506/34 of the Indian Penal Code. There is allegation in the written report that the petitioner along with other accused persons has kidnapped the minor daughter of the informant.

Case diary has been received.

The statement of victim girl recorded under Section 164 Cr. P.C. is available in the case diary wherein she has levelled specific allegation against the petitioner and another accused Sonu of committing illegal act with her on the point of knife. The girl has stated her age as 14 years. She was medically examined. The

Patna High Court Cr.Misc. No.13090 of 2017 (3) dt.19-04-2017 doctor has assessed her age between 15 to 16 years. In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of petitioner stands rejected.

Petitioner is directed to surrender before the court below and make prayer for regular bail.
