The petitioners seek bail in a case registered for offences punishable under Section 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 80.25 litres of foreign liquor was recovered from a car which was being boarded by the petitioners. It is contended that nothing has been recovered from the conscious possession of the petitioners and they have been falsely implicated in the present case. Petitioners claim that they are having clean antecedent and are in custody since 11.8.2018.

No.58767 of 2018(2) dt.06-10-2018 2/2 Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya, in connection with Sherghati Excise Case No. 286 of 2018 of Barachatti P.S. with further conditions that one of the bailors of the petitioner no. 2 must be the resident of State of Bihar. If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
