JUSTICE SANJAY PRIYA ORAL ORDER 3/ 17-05-2017 This modification application has been filed for modification of the order dated 07.08.2014 passed in Cr. Misc. No.20468 of 2014 by a co-ordinate Bench of this Court by which the petitioners were granted anticipatory bail on certain condition in connection with Jehanabad P.S. Case No.310 of 2013. It has been submitted that the petitioners could not furnish bail bonds because their mother was suffering from Cancer. It is further submitted that, now, they are ready to make payment of rupees five lacs to the informant as directed by order dated 07.08.2014 passed in Cr. Misc. No.20468 of 2014. Learned counsel for the Opposite Party No.2 is ready to accept the aforesaid amount.

Since the petitioners could not comply the order

Patna High Court Cr.Misc. No.13308 of 2017 (3) dt.17-05-2017 2/2 dated 07.08.2014 passed in Cr. Misc. No.20468 of 2014, this Court is not inclined to allow the modification application. The application is dismissed.

However, in the event, the petitioners surrender in the Court below and produces receipt showing payment of rupees five lacs to the informant through Demand Draft in terms of the order dated 07.08.2014 passed in Cr. Misc. No.20468 of 2014, the Court below will pass appropriate order on the same day in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
