The matter has been pending since 2019. Hence, the learned counsel for the petitioner presses that let the order be passed on merit.

The petitioner is apprehending his arrest in connection with Tariyani P.S. case No.02/2017 registered under Sections 304(B)/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner caused death of the sister of the informant due to nonfulfilment of demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

A petition has been filed by the informant in the court below stating that the deceased is said to have caught fire while she was cooking and subsequently she succumbed to the burn injuries. The informant has retracted from his earlier statement made in the F.I.R.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. case No.02/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
