JUSTICE PARTHA SARTHY ORAL ORDER 24-12-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per the prosecution case, the accused persons fled away with the informant's motorcycle, clothes as also assaulting him with the helmet.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. The material that has transpired in course of investigation has been dealt with by the learned trial court in the order rejecting the application for bail of the petitioner. Referring to the same it is submitted that the name of the petitioner transpired in the confessional

Patna High Court CR. MISC. No.36072 of 2021(2) dt.24-12-2021 2/2 statement of a co-accused made before the police. No incriminating article has been recovered from the petitioner's possession. Inspite of being in custody since 24.2.2021 and chargesheet having been submitted in the case, the petitioner has not been put on T.I. parade.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the fact of chargesheet having been submitted, the petitioner is directed to be enlarged on bail in connection with Jalalpur P.S. Case no. 163 of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 9th , Saran at Chapra.
