Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 409 of the Indian Penal Code.
Accusation against the petitioner is that in the financial year 2013-14 and 2014-15 the petitioner ran the brick kiln without deposing the tax amount which was calculate to the tune of Rs. 1,50,000/-.
It is submitted by the learned counsel for the petitioner that the petitioner is ready to deposit the due tax within a period of five months.
Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for
Patna High Court Cr.Misc. No.35461 of 2015 (2) dt.03-09-2015 five month in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Chainpur P.S. Case No. 84 of 2015, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The provision bail will be confirmed by the learned court below after depositing the due tax amount by the petitioner.
