JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and three others are named in the first information report and it is alleged that petitioner as well as other F.I.R named accused and two unknown persons came runing and, thereafter, petitioner opened fire on the informant but firing of the petitioner did not hit the informant. However, one co-accused Yogi fired on the informant which hit on back of the informant. Submission on behalf of the petitioner is that petitioner is in jail custody since 6.04.2016 and, as matter of fact, he has been implicated in this case due to village politics. Moreover, petitioner does not have any criminal antecedent.

No.47243 of 2016 (2) dt.08-12-2016 2/2 Considering the accusation leveled against the petitioner as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Session Judge, Bhagalpur in connection with Session trial no. 588 of 2016 arising out of Nathnagar (Madhusudanpur) P.S.Case No. 109 of 2016.
