The application is for grant of bail for the offence under Section 394, 302 of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner has been made accused on the basis of confessional statement of co-accused and no incriminating article is recovered from his possession and he is in custody since 10.09.2016. It has further been submitted that charge-sheet has already been submitted.
Heard learned A.P.P. also. Learned A.P.P. could not controvert the aforesaid fact.
Patna High Court Cr.Misc. No.49417 of 2016 (3) dt.12-01-2017 2/2 Having heard both sides. In view of the fact stated above and as the petitioner has been made accused on the basis of confessional statement of co-accused and there is nothing else against him and charge sheet has already been submitted, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. case no. 65 of 2016.
