JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-08-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code.
The prosecution case is that due to land dispute the accused Khodija ordered her son Md. Rehmtulla to lit fire to the hut of the informant on which he set the house of the informant on fire.
It is submitted by the learned counsel for the petitioners that specific accusation is against co-accused Khodija and not against the petitioners and due to their presence they have falsely been implicated in the present case.
Considering the nature of accusation levelled against the petitioners, let the petitioners, above named, in the event of their
Patna High Court Cr.Misc. No.35703 of 2015 (2) dt.21-08-2015 2/2 arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, West Muzaffarpur in connection with Kanti P.S. Case No. 106 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
