03.09.2020 Heard Mr. Radha Mohan Singh, learned counsel for the petitioner, Mr. Ram Priya Sharan Singh, learned counsel for the State. The petitioner seeks bail in anticipation of her arrest in connection with Taraiya P.S. Case No. 96 of 2019 dated 29.03.2019 instituted for the offence under Sections 302/34 of the Indian Penal Code.
The petitioner and her family members are alleged to have assaulted the father of the informant leading to his death. It has been submitted on behalf of the petitioner that there is general and omnibus allegation and only because of past dispute between the agnates, the petitioner also has been made accused in this case. It has further been brought to the notice of the Court that the petitioner is the married daughter of the village and at the relevant time she was not even present in her parental home. Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of her arrest or surrender before the court below on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Saran at Chhapra in connection with Taraiya P.S. Case No. 96 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
