JUSTICE ARUN KUMAR ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner already in custody in connection with Jehanabad (Karauna) P.S. Case No.95 of 2016 is an accused in a case registered under Sections 435, 427 and 385/34 of the Indian Penal Code as well as Sections 16, 18, 20, 21 and 22 of the U.A.P. Act, 1967.

Allegation in brief is that the Excavator of the contractor, which was being used for road construction, was set to fire by some unknown miscreants.

It is submitted that except the disclosure of the name of this petitioner by Samundar Yadav and Shyamdeo Mochi, there is no material against this petitioner and Samundar Yadav and Shyamdeo Mochi were earlier granted bail by a coordinate Bench

Patna High Court Cr.Misc. No.50015 of 2016 (4) dt.08-03-2017 2 / 2 of this Court by order dated 21.12.2016 and 17.01.2017, passed in Cr. Misc. No.45108 of 2016 and Cr. Misc. No.54226 of 2016 respectively.

Having considered the said facts and circumstances, let the petitioner, namely, Nand Kishore Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad (Karauna) P.S. Case No.95 of 2016.
