JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 307/34, 379, 504, 323 and 341 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has no criminal antecedent and the police after investigation submitted the final report showing the petitioner to be innocent. He further submits that the learned Judicial Magistrate, however, differing with the police report, has taken cognizance necessitating the petitioner to approach this Court for grant of anticipatory bail. He has also submitted that other co-accused, namely, Bhola

Patna High Court Cr.Misc. No.43156 of 2014 (2) dt.20-03-2015 2/2 Singh, Vijay Singh and Sanjay Singh, have been granted the privilege of anticipatory bail by an order passed by another Bench of this Court dated 29.04.2013 in Cr. Misc. No. 17835 of 2013.

In view of the submissions made above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No. 75 of 2013, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
