JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory arises out of Phulwari Sharif Police Station Case No. 471 of 2014, disclosing offences under Sections 452,323,504,506,354 of the Indian Penal Code.

Learned Senior Counsel appearing on behalf of the petitioner submits that keeping in view the nature of accusation and the age of the petitioner, he may be given the privilege of anticipatory bail. The father of the petitioner is personally present in Court in compliance of the order dated 31.03.2016.

Considering the facts and circumstances of the case, this application is allowed.

Let the petitioner above-named in the event of his

arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Jyoti Prakash, learned Judicial Magistrate, Ist Class, Patna in Phulwari Sharif P.S. Case No. 471 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.

This is subject to the further condition that one of the bailors shall be the father of the petitioner.
