The petitioner seeks bail in Parbatta (Maraiya) P.S. case No. 255 of 2017registered under Section 395 of the Indian Penal Code.
The informant named six persons and two unknown and alleged that the name accused persons along with two unknown persons intercepted them and snatched cash and mobile from their possession and fled away.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. During the course of investigation the name of petitioner figured in the case in the confessional statement of co-accused Jangla Yadav and Domi Mandal but save and except confession no other material was collected to show involvement of the petitioner. The petitioner is in custody since 02.06.2018 but he has not been put in T.I. parade. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that although
Patna High Court Cr.Misc. No.61522 of 2018 (2) dt.06-10-2018 2/2 petitioner was arrested but no looted article was recovered from his possession, the petitioner was not even put in T. I. parade although he is in custody since 02.06.2018, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Khagaria in connection with Parbatta (Maraiya) P.S. case No. 255 of 2017.
