JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 29-11-2016 Heard the counsel for the petitioner and the State. The petitioner prays for bail in Barachatty P.S. Case No. 80 of 2016 registered under sections 402 and 414 IPC. On secret information, the police are said to have raided an orchard wherefrom 03 accused persons, including the petitioner, were arrested. The petitioner was found in possession of a mobile phone.
It is stated that the petitioner is in custody since 18.03.2016. He was previously accused in a minor occurrence in which he was granted bail. On the alleged confession of the coaccused, he has been cited accused in three more cases. Be that as it may, in the facts and circumstances of the case, let the petitioner above named be released on bail on
Patna High Court Cr.Misc. No.47854 of 2016 (3) dt.29-11-2016 2/2 furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Sherghatty, Gaya in Barachatty P.S. Case No. 80 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law. (Kishore Kumar Mandal, J) HR/- U T
