The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, a total of 754.5 litres of liquor is said to have been recovered from the part of the house of the petitioner which did not fall in the petitioner's share.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 23.1.2021.

The application for bail is opposed by learned

Patna High Court CR. MISC. No.30670 of 2021(4) dt.24-01-2022 2/2 A.P.P. for the State who submits that petitioner has an antecedent under the Bihar Prohibition and Excise Act, 2016. Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.6515 of 2020 (Maner P.S. Case no.608 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
