2. The petitioner seeks bail in connection with Amnour P.S. Case No. 164 of 2024 registered for the offences under Section 395 of the IPC.

3. The petitioner is not named in the F.I.R. and is in custody since 13.09.2024.

4. The allegation against the petitioner is to commit dacoity in Central Bank of India, Apher Branch along with other co-accused persons and while committing so, looted cash of Rs. 8,94,988/-.

5. Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner transpired in

No.19560 of 2025(4) dt.08-08-2025 2/3 the present case on the basis of confessional story of coaccused Janu Kumar Sah @ mangal Kumar @ Mangol Kumar @ Janu Kumar Rai who was granted bail by this Court through Cr. Misc No. 88785 of 2024 vide order dated 28.02.2025. It is submitted that nothing incriminating recovered/surfaced during the course of investigation, so as to connect this petitioner prima-facie with the present occurrence of dacoity. It is submitted that petitioner was not put on T.I.P. as yet. While concluding the argument it is submitted that beside this case petitioner found involved in one more criminal case, where he is on bail and moreover, investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. In view of the facts and circumstances as mentioned above and by taking note of fact as save and except suspicion arising out of confessional statement of coaccused where nothing appears incriminating during the course of investigation so as to connect this peitioner prima-

No.19560 of 2025(4) dt.08-08-2025 3/3 facie with the present occurrence of dacoity, coupled with the fact as petitioner is in custody since 13.09.2024, where charge-sheet has already submitted, accordingly, petitioner, above named, is directed to be released on bail in connection with Amnour P.S. Case No. 164 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned JM 1st Class, Saran, Chapra/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480 (3) of the BNSS.
