JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149 and 302 of the Indian Penal Code and 27 of the Arms Act.

Allegation is husband of informant was fired shot on the chest by one Pintu and petitioner along with others also took part in that occurrence, Informant's husband was declared dead at P.M.C.H.

It has been submitted on behalf of petitioner that he was granted regular bail vide Annexure-2 to the present application. Thereafter, petitioner being daily wage labourer had gone out for his bread and butter and could not make proper pairbi. It is a case of misuse of privilege of bail of four years. He has remained in custody for more than five months.

On behalf of the State, it is submitted that petitioner has misused the privilege of bail granted to him vide Annexure-2 to the present application.

Considering the aforesaid facts and circumstances, let petitioner above named be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.50960 of 2016 (2) dt.25-11-2016 2/2 of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Add,. Sesions Judge, VIII, Saran at Chapra in connection with S.T. no. 880A/11 Reg. No. 224/15 arising out of Parsa P. S. Case no. 1 of 2011.
