The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Tekari P.S. Case no. 364 of 2021 instituted for the offence punishable under Sections 379 and 420 of the Indian Penal Code.

As per allegation in the FIR, informant has provided her gold ornaments to the petitioner for cleaning. It is further alleged that petitioner has fled with ornaments on his motorcycle and after some distance his motorcycle met with a technical problem and one other co-accused left the motorcycle and fled away on foot.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.21042 of 2022(2) dt.22-09-2022 2/2 has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. Nothing has been recovered from his conscious possession nor he was arrested on spot.

Learned APP appearing for the State has opposed the prayer of bail and submitted that the alleged recovered motorcycle from the place of occurrence belongs to petitioner. Having heard learned counsel for the parties and considering the facts and circumstances of the, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
