JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under sections 448, 341, 323, 324, 307, 354, 379/34 of the Indian Penal Code. Allegation is that while the informant was standing at his door, all the accused persons started abusing and assaulted him due to land dispute. It is further alleged that they also snatched Jitiya and Mangal Sutra of his cousin.

It has been submitted on behalf of the petitioner that he is in custody since 18.6.2016. Charge sheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. It is a case and counter case. Both the parties are agnates. There is admitted land dispute between the parties. It is further submitted that the petitioner may be released on bail after completion of six months in custody i.e. from

Patna High Court Cr.Misc. No.34754 of 2016 (3) dt.19-10-2016 18.6.2016.

On behalf of the State, it is submitted that the petitioner is named in the First Information Report.

Considering the aforesaid facts and circumstances, let the abovenamed petitioner be released on bail after completion of six months in custody i.e. from 18.6.2016 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sherghati at Gaya in Dumariya P.S.Case No. 22/2016.
