Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 341, 323, 324, 307, 325, 379, 354(B), 504 and read with 34 of the Indian Penal Code. Allegation against the petitioner is that the petitioner and co-accused persons started assaulting Kavita Devi and wrapped Gamcha in her neck and tried to kill. During that course, she became senseless and nude. They also assaulted Raj Kumar Das causing head injury. Sumit Das assaulted him with Khanti. Sonia Devi was assaulted on her head with rod by Kavita Devi, wife of the petitioner. Tulsi Kumari assaulted with danda. They took away

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Learned counsel for the petitioner has further submitted that there is a case and a counter case between the parties and there is also a land dispute between them. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 25.02.2022.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhubani, in connection with Khajauli P.S. Case No. 23 of 2022.

The application stands allowed.
