JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but it appears from the impugned order that in course of investigation, the name of petitioner surfaced in this case in the statements of the witnesses at paragraphs 26 and 27 of the case diary. Although Sessions Judge, Aurangabad has referred the aforesaid paragraphs but he has not stated as to what has been stated by the witnesses in the aforesaid paragraphs. Moreover, it is specific case of prosecution that it was co-accused Rakesh Kumar, who shot fire on the deceased.

. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.40713 of 2016 (3) dt.23-11-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S.Case No.300 of 2011.
