JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioner is that he had committed murder of husband of informant.

It has been submitted on behalf of petitioner that he is in custody since 13.4.2015. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been made accused in the present case merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest his implication in the present case.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.50624 of 2016 (3) dt.08-12-2016 2/2 amount each to the satisfaction of learned A.D.J.-IXth, Patna, in connection with S. Tr. No. 460 of 2015 arising out of Digha P.S. Case no. 35 of 2015.
