The petitioner apprehends her arrest in connection with Jagdishpur P.S. Case No. 236 of 2016, registered for the offences punishable under Sections 304 (B)/120(B)/34 of the Indian Penal Code.
Allegedly, the petitioner and other co-accused committed murder of the deceased by pouring kerosene oil and burning her.
Submission is of false implication and that the petitioner has got no criminal antecedent in this case, the husband of the petitioner has already been allowed regular bail, Mausam Kumari the daughter of the petitioner has been allowed pre-arrest
Patna High Court Cr.Misc. No.9077 of 2017 (3) dt.25-04-2017 2/2 bail vide Cr. Misc. No. 6662 of 2017 by order dated 07.03.2017 by another co-ordinate bench of this Court. The petitioner is living separately from the husband of the deceased since long, there is no specific allegation against the petitioner and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. submits that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, considering that Mausam Kumari has been allowed pre-arrest bail and further the husband of the petitioner has been allowed regular bail, the petitioner in the event of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Jagdishpur P.S. Case No. 236 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
