The petitioner is in custody in connection with Madhuban P.S. Case No. 302 of 2015 for the offence under Sections 384 and 385 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. He further submits allegation against this petitioner is that he was involved in demanding Rangadari on mobile phone. Learned counsel for the petitioner submits that the name of the petitioner surfaced on the confessional statement of co-accused Santosh Sahani. He submits that petitioner is in custody since 09.01.2019.
Considering the fact that petitioner has no criminal
Patna High Court CR. MISC. No.19310 of 2019(2) dt.29-03-2019 2/2 antecedent, the Court is inclined to enlarge the petitioner on bail. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IV Motihari, East Champaran, in connection with Madhuban P.S. Case No. 302 of 2015, subject to the conditions that both bailors should be family members of the petitioner.
