ANJANA MISHRA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of O.P. No.2 as well as the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Brahampura P.S. Case No.165 of 2015 for allegedly having committed the offence under Sections 342, 354(B) and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that out and out a mischievous allegation has been made against the petitioner only because he had dismissed O.P. No.2 for dereliction of duty. He further submits that the petitioner is a
Patna High Court Cr.Misc. No.36747 of 2015 (4) dt.15-12-2015 2/3 responsible Doctor having a clinic and only to tarnish his image, the present case has been lodged against him. He further submits that the petitioner is willing and ready to co-operate in the investigation and shall be making himself available as and when required in the court below.
Learned counsel for O.P. No.2 has resisted the application and submits that the informant is a poor girl and also a local and she had gone there to work, but on account of the behaviour of the concerned Doctor, she was compelled to file the present case.
Learned counsel for the State submits that there is no further cogent material in the case diary so as to implicate the petitioner.
Considering the entire gamut of circumstances and that the petitioner is a responsible Medical Practitioner and has undertaken to co-operate in the investigation as well as trial, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
