JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-12-2021 Heard Mr. N.K. Agrawal, learned senior counsel along with Ms. Preety Kunwar, learned counsel for the petitioner and learned counsel for the State. In view of the office note dated 02-12-2021, learned counsel for the petitioner is permitted to make necessary correction with regard to "year of the P.S. Case" in the 1st paragraph and prayer portion of this bail application as in the 1st paragraph "Yogapatty P.S. Case No. 336 of 2019" has been mentioned, whereas, in the prayer portion "Yogapatty P.S. Case No. 336 of 2020" has been typed.
Petitioner seeks regular bail in connection with Yogapatty P.S. Case No. 336 of 2019 registered for the offence under Section 341, 323, 324, 307,504, 506 / 34 of the I.P.C. The allegation as per the First Information Report is that the petitioner allegedly assaulted the informant on his head
Patna High Court CR. MISC. No.30679 of 2021(3) dt.08-12-2021 2/2 by means of garasa due to which he received head injury. Learned senior counsel for the petitioner submits that both the parties are close relative and there is land dispute between them. He next submits that petitioner is in custody since 02-02- 2021 and charge sheet has already been submitted. Learned counsel for the informant opposes the bail application and submits that petitioner has caused grievous injury on the head of the informant.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that both the parties are close relative and there is land dispute between them, I am inclined to grant regular bail to the petitioner upon completion of one year in custody. Accordingly, let the petitioner, above named, be released on regular bail upon completion of one year in custody on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Yogapatty P.S.
