The petitioner is an accused of Raniganj P.S. Case No. 154 of 2016 initially registered under sections 354(B), 452 & 380, but subsequently section 376 IPC was added. The victim lodged the case that at the dead of night, the petitioner forced her to open the door and thereafter lifted her to a nearby field and attempted to rape her. She, however, managed to escape and went to the house of one Pramod Yadav from where all of them came to the house and found articles including cash kept in the house were stolen. The victim in her statement made under section 164 Cr. P.C. supported the prosecution case. It is stated that the petitioner is in custody since 09.07.2016 and out of sheer animosity he has been named in the

Patna High Court Cr.Misc. No.47981 of 2016 (2) dt.24-11-2016 2/2 present case.

Looking to the allegation and other materials reflected from the record, this Court, for the present, is not inclined to extend him the privilege of bail. Prayer is accordingly rejected. The petitioner, however, is granted liberty to renew his prayer for bail after six months.
