The present application for anticipatory bail is the second attempt by the brother-in-law of the deceased. Since no fresh ground is made out, the second anticipatory bail application is not maintainable and the prayer is accordingly rejected.

However, the petitioner shall be at liberty to move the court below after surrendering and the Court below shall consider the prayer for bail on its own merits without being prejudiced by the present order.
