This application for grant of anticipatory bail arises out of Ramgarhwa P.S. Case No. 99 of 2013, disclosing offences under Sections 302/34 of the Indian Penal Code.
This application for grant of anticipatory bail is rejected in view of the admitted that the petitioner is named in the First Information Report alleging offences punishable under Sections 302/34 of the Indian Penal Code. It further appears that the petitioners have been implicated in another case under Section 302 of the Indian Penal Code in the year 2014.
Patna High Court Cr.Misc. No.36824 of 2015 (2) dt.10-09-2015 Following the decision of the Supreme court reported in (2012) 4 SCC 379 ( Jai Prakash Singh Vs. State of Bihar and another), this application is rejected.
The petitioners are directed to surrender before the Court below within six weeks from today and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
