The petitioner apprehends his arrest in Nawada G.O. Case No. 110 of 2015 instituted for the offence under Section(s) 47(a) and F of Bihar Excise Act.
It is alleged that 35 litres of illicit liquor and 160 Kgs of Jawa Mahua were recovered from the house of the petitioner and the seizure list was prepared. The petitioner managed to run away.
The seizure list has been annexed with the prosecution report wherein it has been mentioned that the aforesaid liquor has been recovered from the house of this petitioner.
In such circumstance, this Court is not inclined
Patna High Court Cr.Misc. No.9193 of 2017 (2) dt.28-02-2017 2/2 to enlarge the petitioner on anticipatory bail. The prayer of the petitioner for anticipatory bail is rejected. The petitioner is directed to surrender before the Court below within a period of six weeks from today in connection with Nawada G.O. Case No. 110 of 2015, pending in the Court of learned Chief Judicial Magistrate, Nawada and seek regular bail, which shall be considered and disposed off on its own merit, preferably on the same day, without being prejudiced by the order of this Court.
