The petitioner seeks bail in connection with Phulwariya P.S. Case No.115 of 2018, registered under Sections 363 and 366(A)/34 of the Indian Penal Code. The accusation is of kidnapping of daughter of the informant by the petitioner and Lal Babu Singh both sons of Bindeshwari Singh.

Learned counsel for the petitioner submits that , in fact, due to love affairs, the daughter of the informant left the house and performed married in temple with petitioner on 12.05.2018, which would appear from the statement of the victim, daughter of the informant, recorded under Section 164 of the Cr.P.C. on 02.08.2018 and at the time of recording the statement under

Patna High Court Cr.Misc. No.62351 of 2018(2) dt.06-10-2018 2/2 Section 164 of the Cr.P.C. the victim disclosed her age 19 years and Judicial Magistrate also assessed her age as 18 years. Further submission is that petitioner has no criminal antecedent is in custody since 08.08.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.13, Gopalganj in connection with Phulwariya P.S. Case No. 115 of 2018.
