Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.
Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
There is allegation against the petitioner that he along with co-accused, Kundan Kumar assaulted on the abdomen of the injured, Nisha Damini by means of lathi as a result of which miscarriage was caused but learned counsel for the petitioner drew
Patna High Court Cr.Misc. No.39192 of 2016 (2) dt.26-09-2016 2/2 my attention towards Annexure-2 to the petition and submits that the foetus was found normal though the doctor opined that the injury on placenta may cause damage to the foetus. However, there is case and counter case between the parties and persons from both the sides appear to have sustained injury. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif at Nalanda in connection with Bihar P.S. Case No. 309 of 2016.
