JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 47 of the Bihar Excise Act, 2016.
Allegation against petitioner is that country made liquor is said to have been recovered from his possession. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 16.9.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. From possession of petitioner 71.4 litres of country made liquor is said to have been recovered. No compliance of Section 100 of the Code of Criminal Procedure is made.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case
