JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner, and the learned counsel representing the State.

The petitioner apprehends his arrest in connection with Dhaka (Pachpakari) P.S Case No. 297 of 2016 registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

It is submitted that Manish Kumar Dubey was apprehended with country made Katta and he stated the name of the petitioner that the petitioner has given the said katta to him. There is enmity between the petitioner and Manish Kumar Dubey and due to that Manish Kumar Dubey has taken the name of the petitioner. Nothing has been recovered from possession of the petitioner and, as such, the petitioner deserves sympathetic consideration.

Patna High Court Cr.Misc. No.5933 of 2017 (2) dt.21-02-2017 Learned A.P.P. opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering that nothing has been recovered from possession of the petitioner and his name was taken by the co-accused who was apprehended at the spot with arms and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of the order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana in connection with Dhaka (Pachpakari) P.S. Case No. 297 of 2016, subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
