====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner caused fire arms injury on the chest of the informant.

Learned counsel for the petitioner submits that the instant case has been lodged in retaliation to earlier case filed by the petitioner. It is further submitted that the occurrence is of 23.11.29017, whereas FIR was lodged on 27.11.202017 and there is no plausible explanation of delay. Petitioner is in custody since 26.4.2019.

Patna High Court CR. MISC. No.30229 of 2021(5) dt.22-11-2021 2/2 Learned counsel appearing for the State and the informant oppose the prayer for bail. They submit that there is specific allegation against the petitioner of causing fire arms injury to the informant. He has also got criminal antecedent of 14 cases.

Considering the nature of accusation against the petitioner and his criminal antecedent, prayer for bail of the petitioner is refused.
