JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-408, 420 of the Indian Penal Code.
Petitioner was working as Junior Custodian and it is alleged that the petitioner and other FIR named accused embezzled near about Rs. 1.5 crores, which had to be deposited in ATM machines but submission on behalf of petitioner is that the petitioner joined the concerned company in February, 2016 whereas; the occurrence is said to have taken place from August to November, 2015. It is further submitted that the aforesaid fact is corroborated by paragraph-6 of the case diary as well as page 24 of the petition. It is further submitted that moreover, co-accused Rahul Kumar and Avinash Kumar, having more or similar
Patna High Court Cr.Misc. No.40302 of 2016 (5) dt.21-11-2016 2/2 allegation, have already been granted privilege of anticipatory bail by a coordinate bench of this court.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Digha P.S. Case No. 118 of 2016 to the satisfaction of Md. Inam Khan, learned J.M.-Ist Class, Sadar, Patna.
